End User License Agreement

1. Acceptance and Relationship to Apple Terms

By downloading, installing, accessing, or using Mole Tracker, you agree to this EULA. If you downloaded the app from the Apple App Store, Apple's standard Licensed Application End User License Agreement also applies to your use of the app. If there is a conflict between this EULA and Apple's mandatory terms, Apple's mandatory terms will control to the extent of that conflict.

2. Eligibility and Authority

You must be legally capable of entering into this agreement. If you create or manage a profile for another person, including a child or family member, you represent that you have authority to do so and to provide related information and photos inside the app.

3. Limited License

Subject to this EULA, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to use Mole Tracker on Apple-branded devices that you own or control, solely for your personal, non-commercial use and in accordance with Apple's usage rules.

4. What the App Does

Mole Tracker helps you record skin and mole observations, store photos, manage body-map placements, review UV index information, receive reminders, export reports, and request AI-assisted analysis.

5. Subscriptions and Billing

• Some features may require a paid subscription.
• Prices, billing periods, and included features are shown in the app and in the App Store before purchase.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Auto-renewable subscriptions renew automatically unless you turn off auto-renew at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in your Apple ID account settings.
• Purchase restoration is available through the app where supported by Apple.

6. Medical and AI Disclaimer

Mole Tracker does not diagnose cancer, melanoma, or any other medical condition. AI-generated outputs, classifications, descriptions, and warnings are informational only and may be incomplete, inaccurate, delayed, or incorrect.

Do not use the app or its AI outputs to make emergency or urgent medical decisions. If you notice a suspicious lesion, rapid change, bleeding, pain, or another concerning symptom, consult a qualified healthcare professional promptly.

7. Your Responsibilities

• You are responsible for the accuracy of the information, photos, and notes you upload or enter.
• You should use clear, lawful, and relevant images and only upload content you are authorized to use.
• You must not use the app to violate privacy rights, collect data unlawfully, or transmit harmful, abusive, infringing, or illegal content.
• You are responsible for reviewing subscription details, keeping your device secure, and controlling who can access the app on your device.

8. Restrictions

You agree not to:

• copy, rent, lease, sublicense, sell, or redistribute the app except as allowed by law;
• reverse engineer, decompile, disassemble, or attempt to extract source code except where applicable law permits;
• interfere with the app, its servers, or related infrastructure;
• use the app in a way that could create medical, safety, legal, or regulatory risk for others.

9. Third-Party Services

Certain features rely on third-party services, including Apple, iCloud, StoreKit, weather and location providers, subscription tooling, remote configuration services, and AI providers. Those services may be governed by their own terms and privacy notices.

10. Updates and Availability

We may release updates, patches, feature changes, or removals at any time. Some features may change, become limited, or stop working if third-party services, operating systems, hardware, connectivity, or platform rules change.

11. Ownership

The app, including its software, design, branding, text, graphics, and underlying intellectual property, is owned by FlashSoft Apps or its licensors and is protected by applicable law. This EULA grants a limited right to use the app, not ownership of it.

12. Warranty Disclaimer

To the fullest extent permitted by law, the app and related services are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and reliability.

13. Limitation of Liability

To the fullest extent permitted by law, FlashSoft Apps and its service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, revenue, profits, goodwill, or health-related outcomes arising from or related to your use of the app. Nothing in this EULA limits rights that cannot be waived under applicable consumer law.

14. Suspension and Termination

This EULA remains in effect until terminated. We may suspend or terminate access if you materially breach this EULA, misuse the service, create risk for others, or where required by law. You may stop using the app at any time by uninstalling it and discontinuing use.

15. Apple-Specific Notice

Apple is not responsible for providing maintenance or support for the app. To the extent a warranty exists under law and is not effectively disclaimed, Apple may be responsible only as required by applicable law. Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.

16. Changes to This EULA

We may update this EULA from time to time. Continued use of the app after an update becomes effective means you accept the updated EULA, unless applicable law requires additional consent.
